Appreciation of Evidence: Principles, Judicial Approaches and Contemporary Challenges in the Administration of Justice
Abstract
The process of appreciation of evidence constitutes the foundation of judicial fact-finding and plays a decisive role in the administration of justice. While the law of evidence primarily regulates the admissibility of evidence, appreciation of evidence concerns the evaluation of reliability, credibility, relevance, and probative value of evidence presented before a court. Judicial determination of facts depends not merely upon the existence of evidence but upon the manner in which such evidence is assessed and weighed. This article examines the concept, objectives, and principles governing appreciation of evidence with particular reference to Indian jurisprudence. It analyses the judicial approach towards various forms of evidence and highlights the challenges encountered by courts in evaluating evidentiary material. The study argues that appreciation of evidence is both a legal science and a judicial art requiring objectivity, logical reasoning, practical wisdom, and adherence to established principles of law.
