Abstract

The advent of digital technology has revolutionised press freedom in India by broadening the scope of news dissemination but also by posing regulatory complexities. The emergence of digital news outlets, social media, and citizen journalism has enabled greater access to information but also posed challenges with issues such as disinformation, hate speech, and accountability. In India, the constitutional right to freedom of speech and expression under Article 19(1)(a) forms the basis for press freedom; but this freedom is not absolute and can be curtailed by reasonable restrictions under Article 19(2). The lack of a dedicated law governing digital news media has resulted in the use of piecemeal regulations such as the Information Technology Rules, 2021. This has raised questions about state interference, censorship, and independence of online journalism. The balance between upholding democratic values and promoting responsible media is at stake. This research critically explores the regulatory strategies taken in India, with a focus on the tensions between press freedom and the need to control misinformation and maintain law and order. It calls for a sophisticated, transparent and rights-oriented regulatory approach that maintains the fundamental values of press freedom while responding to the challenges of the digital era.
